• Before Services Commence: If a refund is requested immediately after payment but before the Firm begins work (including before the intake form is sent), the maximum refund available is $1,249.00 (purchase price minus $350.00 administrative fee).
• After Clearance Search Completion: If the Firm has conducted the trademark clearance search, the maximum refund available is $899.00 (purchase price minus $700.00).
• After Additional Searches: Each additional search requested beyond the initial clearance search incurs a non-refundable fee of $300.00.
• After USPTO Filing: Once the trademark application has been submitted to the United States Patent and Trademark Office (USPTO), no refunds will be provided under any circumstances.

By purchasing our trademark services, you authorize any qualified member of Ross & Owens Ross Law LLC to handle your trademark application. Our team includes licensed attorneys, paralegals, and administrative personnel. While Dawn Owens Ross, Esq. is the founding attorney, your application may be assigned to any qualified attorney within the Firm for review and filing.

Included in Your $1,599 Package:

• Brand Strategy Session (30 minutes): Strategic consultation to position your trademark for success
• Clearance Search: Comprehensive search to identify potential conflicts before filing
• Application Preparation and Filing: Complete preparation and electronic filing with USPTO
• Non-Substantive Office Action Response: Handling of minor administrative issues raised by USPTO

Not Included (Requires Additional Agreement and Payment):

• Substantive Office Action responses (refusals based on likelihood of confusion, descriptiveness, etc.)
• Appeals to the Trademark Trial and Appeal Board
• Opposition or cancellation proceedings
• International trademark filings
• Trademark monitoring services
• Renewal filings
• Post-registration maintenance

The Firm's representation is limited to the services explicitly listed above. Additional services beyond those specified require separate agreement and payment. By purchasing this service, you acknowledge that Ross & Owens Ross Law LLC is retained solely for the specified services and is not obligated to provide additional services without further compensation and written agreement.

To ensure successful completion of your trademark application, the client agrees to:

Communication and Response Obligations:

• Complete the intake form within 14 days of receipt
• Respond to all Firm communications within 5 business days
• Provide accurate and current contact information (email, phone, mailing address)
• Notify the Firm immediately of any changes to contact information
• Check email regularly for time-sensitive USPTO correspondence

Information and Documentation Requirements:

• Provide truthful, complete, and accurate information about the trademark and its use
• Submit clear specimens showing actual use of the mark in commerce (if applicable)
• Disclose any prior trademark applications or registrations for the same or similar marks
• Provide accurate descriptions of goods and services
• Submit all requested documentation in the format specified by the Firm

Legal and Compliance Obligations:

• Confirm ownership rights to the trademark before filing
• Ensure the mark is not confusingly similar to existing marks to the best of client's knowledge
• Maintain continuous use of the mark in commerce (for use-based applications)
• Inform the Firm of any office actions, correspondence, or notices received directly from USPTO
• Comply with all USPTO rules and deadlines

Financial Responsibilities:

• Pay all fees promptly as agreed
• Cover costs for any additional services requested beyond the initial package
• Understand that USPTO filing fees are non-refundable regardless of application outcome

Consequences of Non-Compliance: Failure to fulfill these responsibilities may result in:

• Delays in application processing
• Abandonment of the trademark application by USPTO
• Additional fees for expedited handling or refiling
• Termination of representation by the Firm
• Loss of filing fees and priority dates

The client acknowledges that the Firm cannot guarantee trademark registration and that the client's compliance with these responsibilities is essential for the successful prosecution of the trademark application.
